This policy applies only to information we collect in the App and/or through email in connection with the App.

If you do not agree with our policies and practices, do not download, register with, or use the App. By downloading, registering with, or using the App, you agree to this privacy policy. This policy may change from time to time. Your continued use of the App after we revise this policy means you accept those changes, so please check the policy periodically for updates.
Children Under the Age of 13
Children under 13 using the App are required to obtain parental consent before using the App. We do not knowingly collect Personal Information (defined in Information You Provide to Us below) from children under 13. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@tonalenergy.com.

We collect information from and about users of the App:

Information You Provide to Us
When you download, register with, or use the App, we may ask you provide information:
By which you may be personally identified, such as name or email address (“Personal Information”).
Email address, which may include an individual’s name, is the only required Personal Information for student users registering on the App.
This information includes:
Information that you provide by and for logging into the App. This includes information provided at the time of registering to use the App and subscribing to our service. We may also ask you for information when you report a problem with the App.
Records and copies of your correspondence (including email addresses and phone numbers) if you contact us, which shall only be requested from a manager.
We prioritize the security of your Personal Information. Our App uses encryption methods to secure your data during transmission and when stored in our systems. Sensitive information is accessible only to authorized employees, and we enforce strict access controls to protect your data. We also conduct daily backups to safeguard your information and ensure it can be recovered if needed. In the rare case of a security incident, we have incident response procedures in place and are able to minimize any potential risks to your data.
Below are the key mechanisms we have implemented to protect your information:
Encryption
All sensitive data transmitted between your device and our servers is encrypted using HTTPS and TLS protocols, ensuring that data is secure during transmission. User passwords are not stored in plaintext. Instead, we store only a secure hash (SHA1). This means that even if someone gains access to our database, they cannot retrieve your actual password
Backup & Recovery
We perform daily backups of our databases to ensure that data can be recovered in case of any unforeseen events.
Access Control
Access control mechanisms are implemented for ensuring only authorized employees can access sensitive data. Our customers can only access information they are authorized to view.
Network Security
We use HTTPS for secure communication, and our network security protocols include configuring whitelists. This means that only specific individuals with defined permissions can access particular parts of our system.
Automatic Information Collection [and Tracking]
When you download, access, and use the App, it may use technology to automatically collect:
Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including but not limited to traffic data, number of licenses, and use on or through the App.
Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, operating system, and browser type.
Stored Information and Files. The App also may access other information associated with other files stored on your device, only if specifically imported by the user. This may include audio files.
Location Information. This App does not collect real-time information about the location of your device.
If you do not want us to collect this information do not download the App or delete it from your device.
Coppa Compliance Statement
The Company is committed to protecting the rights of children by fully complying with the Children’s Online Privacy Protection Act (COPPA). According to which, it is necessary for us to obtain parental permission for all children under the age of 13 to register as a member or sign up for email communication on any apps that we might create or manage. We do not knowingly accept any information by and children under the age of 13 and will take all reasonable steps to prevent children from subverting this process.
FERPA Compliance Statement
The Company’s policies and our services are design to meet our responsibilities under the Family Educational Rights and Privacy Act (FERPA). We use any provided Student Data for account creation, login, and educational purposes only. We agree to work with each school to jointly ensure compliance with the FERPA regulations to protect the confidentiality of educational records, provide parents and eligible students the opportunity to access and review such records, and limit further disclosure of Personal Information only as necessary to support the school’s educational purposes.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any Personal Information, to:
Provide you with the App and its contents, and any other information, products, or services that you request from us.
Fulfill any other purpose for which you provide it.
Give you notices about your account/subscription, including expiration and renewal notices.
Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
Notify you when App updates are available, and of changes to any products or services we offer or provide through it.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual without restriction.
In addition, we may disclose Personal Information that we collect or you provide:
To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the Company about our App users is among the assets transferred.

For any other purpose disclosed by us when you provide the information.
With your consent.
To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.
Accessing and Correcting Your Personal Information
You can review and change your Personal Information by logging into the App and visiting your account profile page. If you want to delete your Personal Information, you may do so by deleting your user account in the App.
The Texas Data Privacy and Security Act
If you are a Texas resident, you are protected by the Texas Data Privacy and Security Act (TDPSA). Your rights include:
Right to Confirm: You have the right to confirm whether or not we are processing your personal data, and you have the right to access that data.
Right to Correct: You have the right to correct inaccurate information we may have collected from you. Once we receive your request and confirm your identity, we will rectify any inaccuracies on our end.
Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained. Please note that deleting any personal information could prevent us from providing services to you.
Right to Obtain: Obtain a digital copy of your personal data in a readily usable format, if available.
Right to Opt Out: You have the right to opt-out of the sale or sharing of your personal information for the purpose of targeted behavioral advertising. If you exercise your right to opt-out of the sale or sharing of your personal information, we will refrain from sharing your personal information, unless you subsequently provide express authorization for the sharing of your personal information. You may also opt out of profiling performed in furtherance of decisions that produce legal or similarly significant effects. You may designate someone else to serve as your agent to opt out on your behalf.
Other State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information. As of July 2024, twenty states in the United States have passed comprehensive data privacy laws. These states include California, Virginia, Colorado, Connecticut, Utah, Iowa, Indiana, Tennessee, Texas, Florida, Montana, Oregon, Delaware, New Hampshire, New Jersey, Kentucky, Maryland, Nebraska, Minnesota, and Rhode Island. Data Security
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through the App. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
Changes to Our Privacy Policy
We may update our privacy policy from time to time. The date the privacy policy was last revised is identified at the top of the page. You are responsible for periodically visiting the App and this privacy policy to check for any changes. In the event your home state updates its privacy laws after the date this privacy policy was last modified, such law will automatically be integrated into this policy.
